Hi, I recently submitted MN1 form based on Section 1(3) with all the required documents including followings.

- MN1 form (DOB 5th Mar 2002)
- UK Birth certificate (DOB 5th Mar 2012)
- Child foreign passport (DOB 6th Mar 2012)

Date of birth of the existing foreign passport is one day after the UK birth certificate date beause of time difference(different time zone). A letter of explanation from foreign embassy has been attached and got a confirmation from HO through NCS that the letter is Okay to explain the different dates.

I thought HO would use UK birth certificate date for registration but they quoted foreign passport date on the Biometric letter. Any similar experience or idea about which date HO will use for registration certificate in this situation? Thanks.

How didn't you get 2 birth certificates in the first place? If the child was born in a foreign country then how and why would you obtain a UK birth certificate?

The OP hasn't mentioned two birth certificates.

A UK birth certificate & a foreign passport.

Yes, child was born in the UK and got a UK birth certificate. Also, got a passport (together with registration) from home country based on UK birth certificate but date of birth was adjusted to the local time zone(they say rule applies).

The date of birth is an event occurring at a location. Normally, a passport should also record the place of birth. The date of birth on a passport should be consistent with the date on the birth certificate. Therefore, in my humble opinion, the date of birth should also be the date at the place of birth.

It's only more confusing if a foreign passport uses a different time zone other than at the place of birth. I wonder if there is really such a rule or if the foreign passport official was just unnecessarily improvising?

Can you tell us which foreign country?
