Hi All,

My wife has similar situation. Her absences totaling more then normal residency requirement. I was wondering if she qualifies for Excess Absences.
My wife moved to UK to join me from Canada on Jun 2012.
We are married and I have got my British nationality on March 2016.
As she is not here for more then 5 years, I guess she can only apply as spouse of a British citizen hence 3 years residency. Is that correct??
in 2015 she was out of country for 267 days. And in 2014 she was out of country for 90 days. I was wondering if I can apply under Excess Absences as we have our own house here. The house is on my and my wife's name. We are married with two kidz and both kidz are British national.

Does your wife have ILR?

The longer the absences the longer the overall period to have been spent in UK.
Less flexibility in most recent year before application.

Yes, she has ILR for over an year. Actually we both got ILR at same time on Feb 2015.
