Naturalisation requirements

Hi Everyone

I have a question regarding my wifes' naturalisation application. She got ILR last week and she is in UK for more than 4 years on spouse visa. Can she apply for naturalisation straight away or we need to complete one year before she can go for naturalisation?

As I understand, one needs to be in UK for three years or more on spouse visa before he/she can go for naturalisation. Is it correct?

Correct. 3 years residence + ILR
AND
Has spent no more than 270 days outside the UK during those 3 years
Has spent no more than 90 days outside the UK in the last 12 months

Thanks for quick reply Casa. So we dont need to wait for another year on ILR, she can apply next month?

Yes she can as long as she was physically present in the UK 3 years previous to the date she submits the BC application.

If applying through the NCS it will be the date the application is submitted or if applying through the post, the date the HO receive it.

B1 level English + Life in the UK test required.

Your wife may want to consider applying through a NCS which offers the joint BC/Passport application (JCAP) service. This will avoid the need to attend an interview before the passport is issued.

Can anyone please help with the question 6.11 in AN application form?

"6.11) Do you want home office to retain your BRP?

YES [] I confirm that I do not require evidence of my immigration status. Should I subsequently require evidence of my status, I will need to apply for a replacement BRP at my expense.

NO [] I confirm if I granted British citizenship I must return the BRP to the home office within 5 days of receiving the grant of citizenship and if I fail to do so I may receive a financial penalty of upto £1000."


Do we need to return BRP after getting British citizenship? Is that a new rule?

Yes it must be returned within 5 days of your ceremony.

If you are applying through NCS, they can help you fill this in.

Thanks, I got my citizenship in 2013 and still have my BRP? Was I suppose to return it?

No not necessary. The 'BRP return' rule is for citizenship applications made from January 2016.

Wife applying for BC next week, she has MA in marketing from UK , does she need to do another B1 level in English course?.

Jayson65, please start your own topic with the citizenship questions for your spouse. It is rude to tag onto another members topic and creates confusion when people respond. A UK degree, however, is sufficient, and as she recently got ILR LR, she has already met the language requirement.
