My son was born in India on 01/04/2012 and received ILR in UK on 08 Nov 2012

Father received ILR on 08 Nov 2012
Father naturalised on 16 July 2014

Mother received ILR on 08 Nov 2012
Mother on ILR

Query

Doubt 01: Under which section do I apply for my son's naturalisation using FORM MN1
Question number 1.1 on the MN1 form

Doubt 02: For my case, do I need to fill "Section 3 - Parents’ residence in the UK or the British
overseas territories, where applicable"

I have read the guidance but it's a bit confusing.

May I ask a question please: As per your reply I now understand that I come under Section 3(1). Is it because of the below info in the guide? If not, under which section statement do I fall and why?

Below info from guide

section 1(3) birth in the UK to parents who are now settled in the UK or have
become British citizens

section 1(3A) birth in the UK to parents who have joined the armed forces

section 3(1) child whose parents are applying for British citizenship

section 3(2) birth abroad to parents who are British by descent and have lived
in the UK or a British overseas territory

section 3(5) birth abroad to parents who are British by descent but are now
living in the UK or a British overseas territory

section 3(1) children adopted abroad by British citizen parents

section 3(1) children whose parents had renounced and subsequently
resumed British citizenship

section 3(1) any other case not listed below where it is considered to be in the
child’s best interests to be granted British citizenship

section 4D birth abroad to parents serving in the armed forces

Section 3(1) is for children born abroad and who are applying at the same time as the parents or after the parents are already British. The child cannot apply alone if the parents do not apply at the same time or if the parents are not already British, i.e. parents can stay on ILR and apply only for child.

Section 3(1) is an application at the Secretary of States' discretion, i.e. it is not an entitlement to register.
