Form MN1 Father's Settlement Proof

Hello,

I am applying Form MN1 for my child under Section 1(3) (Register child under 16 of a settled parent since birth)

Can I send copies of my (Father) passports and settlement biometric cards?

My originals are gone with my wife's family of settled person visa application.

Please advice.

Why did you not apply for your child first through NCS and then apply for your wife?

You need originals for your child's application.

My wife's visa is expiring on 14th July. I mean I am ready to send her application. Not posted yet.

I thought her application is more important than my son's. She can't over stay.

Also form MN1 takes 6 months max.

Please advice.

You can use NCS at the council to apply for your son, as you then get to keep your original documents for your wife's application.

Yes and you can apply at any one, it does not have to be your local council.

You can also apply using the JCAP scheme where you apply for citizenship and the passport at the same time.

My son 1 year old is in PSB Dependent.

Under form MN1 Section1(3) what should be the child's status should be at the time of application? Do I need to apply for ILR before MN1 for my child? I am sure that not true?

My council may have wrong information on their website. Can you please confirm

No a UK born child DOES NOT require ILR to apply for BC.
My council may have wrong information on their website. Can you please confirm
Likely their information is generic as the form is generic, i.e. many routes to BC can use it.

You only need proof of your ILR status and passport as the child is entitled to register as BC.

I tried contacting my Brent council today. No one picked it up even though in it's website it says that its open on Saturdays. I will try again on Monday.

Alternatively, can I give my copy of BRP and passport for my wife's visa (Family of a settled person 10 year route)? And attach a covering letter stating that I am going to register my son's as citizen?

Is it allowed?

You can apply at ANY council NCS. It does not have to be your council. You still have almost a month till your wife needs to apply, I am sure if you phone around the councils, you will get an appointment before you need to send your wife's application.

Why are you applying for FLR(FP) for your wife and not FLR(M)???

Is this not right? Both 10 year route private life and 2 year or 5 year route online applications go to the same url: https://visas-immigration.service.gov.u ... ily-routes

I answered few questions relevant to me on the online application and it didn't ask to pick form.

I got settlement through 10 year long residence.

If you meet the income requirement of £18,600pa you apply for her on FLR(M) 5 year route to ILR (2 x 2.5 year visas)

If you DO NOT meet the income requirement, then you apply on FLR(FP) 10 year partner route 4 x 2.5 year visas (which means it is 10 years before she can apply for ILR and NOT 10 year route because you have ILR LR).

Then FLR(M) is the correct form. Please continue your spouse visa questions then in the Immigration for Family members sub further further up the main page.
