MN1 Out of Country or Travel

Hi Every one ,

I have few doubts about MN1 application , pls help me with them

- Can we apply MN1 out of UK ? If any one has done it share your experience like how long does it take ?
If we can apply should we apply in VFS or direct at any embassy in the country ?
- Can we travel out of UK while MN1 is in process and at what stage can we travel
- Will they allow at border in uk while returing , if we wait for british passport and collect it to come back to UK

Is the child born in the UK?

Does the child have a valid visa?

Who has ILR as your Tier 1 Ent was refused??

Yes child born in UK
NO child hasnt got any visa
My Tier1 has been approved , Will go for IRL next year on long residance

You can apply for MN1 using NCS at the council and thereby keeping hold of all original documents, but the child will be unable to return to the UK unless holding a British passport OR holding a valid visa.

If you have a spouse as your dependent, they will not be able to apply for ILR with you if you applying using long residence route. Spouse will have to switch to FLR(M) and meet the English and financial requirement, ideally before travelling out of the UK. Their clock towards ILR based on 5 years will also be reset to zero and a new 2 x 2.5 year residence route before they can appl for ILR (unless 10 years LR is reached first).

Thank you very much CR001 for the elobarated reply. Yes I came to know the FLR(M) rule for the dependant. I want to apply flr(m) for dependant (same day service) and mn1 for baby at the same time and once the flr(m) is approved both mom n baby want to travel out of country.

So my doubt is, can the baby travel out of UK after applying MN1 and it is in process and is it legal ?
I want to wait for BP (British passport) rather than applying for a visa for baby to enter to UK. Once he received BP then can he come back to UK with out any problem at port of entry ? and is this legal according to the rules ?
or

Please also direct me where it has mentioned about travel while mn1 is in processing ? I have read the policy guidance but coulndt find any where about the travel while MN1 is in process .

The child can leave the UK, but will not be able to return if they do not hold a visa or a British passport. Simply having a MN1 application pending with HO is not sufficient to re-enter the UK.

Yes it is fine, also depends what the child's nationality is and if dual citizenship is allowed. For example if Indian, you will need to follow the processes to leave India if British citizenship and passport have been issued.

You have to apply within the UK.

It is not mentioned because there is no requirement to remain in the UK while MN1 or AN is processing. You are free to travel after submitting a citizenship application provided the biometrics have been enrolled at the Post Office once the letter for biometrics has been received.

Yes babys nationality would be Indian and after obtaining BP we will surrender the Indian passport and get the surrendering Certificate . Apart from it ,are there any other processes to leave India if British citizenship and passport have been issued ?

Yes, there is an exit process you have to complete if leaving on a British passport.
