HI!
could someone help me for one of mine friend?
basically he got ILR after having 5 years refugee status. He has one child who was born in UK after getting refugee status. He applied ILR for whole family including child and now granted ILR.(CHILD HOLD ILR STATUS)
MY QUESTION IS:
1)Can he apply his child registration as a BC or he has to wait for 1 year as he holds ILR?Which form he needs to use for registration if possible.
2)Can couple apply for naturalization after 1 year as they did not have valid leave before granting refugee status?
Many thanks for your great and very useful information and advises as in the past.

He can apply to register the Child as British. The child also did not need to get ILR. It is form MN1 for a child.

hi CR00!
THANKS FOR YOUR PROMPT REPLY.
BUT CHILD ALREADY HAS ILR WITH HIS PARENTS AND THEY SUGGESTED BY THEIR LAWYER TO WAIT 1 YEAR FOR REGISTRATION AS A BRITISH CITIZEN THROUGH MN1 FORM.
PLEASE COULD YOU EXPLAIN TO ELIMINATE THIS CONFUSION?
MANY THANKS

Please don't post in CAPITALS. It is the same as SHOUTING and is difficult to read.

A UK born child has an entitlement to register as British once EITHER parent is granted ILR. A UK born child does not require ILR to register as BC.

No problem and no inconvenience. Feel free to ask any questions you might have. Seems you have been given some incorrect advice by your lawyer.

Well the child can be registered as Char correctly observed, but applying for SET(P) is free, and in case of a need for urgent travel whiles MN(1) is pending, you will be able to go overseas.

Even though the child was born in the UK, she may require leave to enter and remain if he or she left the UK, and therefore i personally believe that OP does not lose anything in applying for SET(P).

Because you didnt apply for citizenship. Different form, rules and department.

The child received what was applied for.
