Received my application form and supporting documents back

Hello All,

Today I received my application form and supporting documents back but unfortunately it's not what I hoped for.

So they included a letter with my documents with the following:

"... A person applying under this section is required to have been in the UK on the actual date 5 years before making the application... As you were not in the UK on this date, this requirement is not met."

I was living in the UK for a year by then, but unfortunately I was on holiday abroad on the stated date. Fair enough, my bad I guess. The letter continues with this:

"However, if you wish to re-sign and re-date the enclosed application form at section 7, we will be able to continue our consideration. Your application date will be the date that your re-declared application form is received back in the Home Office and, to avoid any further problems, the aplication form should be returned by the 20/11/2017."

So, my question is:
  • as they sent back all the supporting documents, should I send everything back or only the application form with the re-dated section 7 part? (I guess they only need the form back, but I just want to make sure)
I also hope that it doesn't start the 6 months waiting period over, they just continue as it's stated in the letter...

This is the one requirement where HO cannot apply discretion. It is your responsibility to understand the requirements, there is guidance available with form AN & also the booklet which they expect you to read before applying. If you want your application to be considered after re declaring it then send all the supporting documents back, otherwise they may refuse your application.

Vyergas can you tell me after how many months you received the answer ? That it been declined?

Thanks for the reply bruteforce.

The only confusing part in the letter is "the aplication form should be returned...". Shouldn't it be "the aplication form and the supporting documents should be returned..." For me it sounds like they are done with everything or they have their copies now and only need the re-dated application form. But yeah, it doesn't hurt to send everything back.

Hey cristiano1988. Approximately 2 months. And as far as I can tell it wasn't declined, they just asked me to change the date on the application form.
