HI All,

I am asking this question for one of my friend who is back home in India.

She came here on two years spouse Visa in 2012, but her husband sent her back to India in just 4 months of coming. She gave birth to his child back home in India and since then the husband is not calling back her and just wrote a letter that he is looking for divorce from her.

The child is now 4 years.

Her mother was married to him legally in India and the marriage was registered in India too and on that documents she got spouse visa to go to UK.

is their any chance that she can apply any citizenship for his son back home in India ?
As the husband is no more contacting him anymore.

Thanks

If the child's father was or is British at the time the child was born the child is automatically British by decent and could apply for a passport directly. Evidence of fathers citizenship will be required.

It'll be easier with the father's help.

What happens if the father gets his ILR/citizenship after a child is born abroad to a non uk resident? Someone I know has been abandoned as well in India. Her daughter was born in India. She also came to the UK and lived with the husband and went back to give birth and since has not returned. Child is almost 3. At the time of the birth the father was still on a visa however he may have British Citizenship now.

Can the Mother apply for her daughter's citizenship based on her Dad's? The guy has recently filed for a divorce from the UK as well which proves they were married at the time of the birth of their daughter, although he has not mentioned the daughter's name in the divorce papers.

If the father obtained his British citizenship after the child was born outside the UK, then it's there little/no help.
