ILR, British citizenship and Opportunity in USA

Dear friends

I need a small favour from you. I have few queries, please could you answer them when you have a chance.

1. Currently I am a British citizen, my wife and my daughter are still on Tier 1 Gen dep visas, and they will qualify for ILR in Sep 2019. So, next year I will apply for their ILR in Sep 2019 using premium appt. Assuming they get ILR, can I apply for british citizenship straightaway for them as I am already a citizen and they have been living with me for last 5 years to qualify for ILR.

2. I have an opportunity to work in USA. If I relocate with my family to US, do they still qualify for ILR in Sep 2019? Alternatively if I travel to USA couple of weeks every month and then stay in UK with my family for the other two weeks, will this affect their ILR applications?

Please could anyone answer above queries.

1. Yes, as soon as they get ILR they can apply for citizenship.

2. No they likely won't. They will need to satisfy the 'future intentions' aspect for citizenship. For ILR, their visas are wholly dependent on your being 'settled' in the UK.

Thanks for the prompt response.

Please could you answer my query, if I travel to US on work (myself alone, my family will stay in UK only), stay there for couple of weeks every week, and then stay the remaining two weeks in UK. Do you think this will affect their ILR application? Please note they will stay in UK only, its just me who will be travelling to States.

Please could you let me know.

As CR001, the principle is that you should be settled in the UK. How that is determined and how much the HO looks into it is difficult to assess.
Your travel pattern as shown by itself does not necessarily disqualify you especially if you own a home here or have other strong connections which I am sure you have.
Look through the SET (M) form - if you have residence in the UK and you have enough savings or your wife is working and meets the income threshold, you may not even need to give any information that you have a job overseas.

The OP's dependents are on Tier 1 General dependent visas not spouse settlement visa.
