BC for child born in UK with one parent on ILR

Hi all,

Please I have a question I can't find answers on the forum

1). When a child born in the UK to parents without ILR but one parent now has ILR but the child status is Child Dependant (living in UK for 2years) can that child apply for British Citizenship straight away or does the child have to wait till the other parent has ILR also before the child can apply for BC?

A UK born child can apply for citizenship as soon as EITHER parent gets ILR.

Did this rule just change please?. because I read somewhere on the forum some months back that both parents need to have ILR because the child has child and mother dependant status?

No, there has been no 'rule change', it has been the same for a long time. Only one parents needs ILR for a UK born child to register as British, which is an entitlement to register. This is regardless of whether the UK born child has a dependent visa or not.

Both parents holding ILR is ONLY applicable for children born ABROAD and the child holding ILR as well!!

Oh forgot to say after the child was born, the child left with the mother without any applications and then came back after a year under status of child and mother dependants

Not relevant to UK born child's entitlement.
