Hi All,
I really need your help! Maybe someone here as similar situation in past and could provide some light on my preoccupation
I received my BRP card this morning by post signed issued on 22/10/18 but I had a baby girl born same 22/10/18. I haven’t received the letter from Home Office yet nor my documents back.
In that kind of situation, is my daughter British or do I have to register her as British first?
Please please please help!!
And good luck to the rest of you waiting 🙏🏻🙏🏻🙏🏻

A UK born baby can be registered for British citizenship when one parent is granted ILR.
However if the baby is born when you were already settled (even on the same day), then the baby is automatically a British citizen

that's interesting.
You must be a settled person "before" the birth, then the baby is automatically British citizen.
Date on the BRP is the date when the BRP was issued and not always necessary the date of settlement or date of grant of initial leave. Wait for the letter and see.

Having said the, if the date of settlement is the same as date of birth, why not apply for the passport with covering letter (+documents) explaining the situation and see what happens ! Fee for the passport is not much as compared to registration fee. There's only one way to find out.

Baby should be okay.

Try not to surrender parent's ILR BRP.

Apply for a British passport.

Thanks Zimba for your reply. Baby born around 2am in the morning and décision letter dated 22nd October so that’s the office hours matters or not? Lol there is time on décision letter but office opens at 8am right?
Hummm it’s really confusing. But again I don’t think the birth time gets mentioned on birth certificate tho hum hum, I know I am raising a legal situation here they should have thought of 😅

I actually received décision through Royal Mail later on today and also dated 22nd October so definitely same day as BRP card issue date.
Hummm I will try applying directly for British passport once I have made her birth certificate ☺️

I hope baby will be ok because quite a big gap between fees for registration and just applying for passport 😩😅
