Good Character criteria

Hi all...
I wonder if you can help me better understand the new rule please
Overstayed from October 2000 until she got her DLR in 2011
ILR April 2018 after being on DLR- 6 years (3 years+ 3 years)
The 1st DLR was in 2011 and the 2nd 2014. She ILR in April 2018.
Applied for her BC in Apil 2019
I've only just seen the rule change today while browsing on this forum.
Will her BC application comeback as an automatic refusal?

it depends from each case and wether the case worker is having a good day and gave a discretion.
What was the reason of the overstay?
I have the same situation but will apply this summer

Well..... i genuinely don't know what reason she gave when she applied for her DLR but on top of my head i think she just did not go back after marriage fell apart and had no more family ties

I guess she'll have to wait and see eh... if discretion is exercised in her case... bit thanks for the reply

Overstaying within the last 10 years will be a problem as discretion generally in not applied.

Unless you can proof that you have not worked illegally and you were still under care of the council or organisation for whatever reason.
Everyone who has applied would get sent a letter to respond where about was he/she able to finance themselves. So unless you can proof you have not worked when you had no claim then you should be fine.
In my case i was looked after by the NSPCC until i received my first DLR in 2011. I was without leave from 2005 until 2011.
