Hi Everyone,

Below is my current family status:
1. Husband (having British passport)
2. Daughter (having British passport)
3. Wife (having ILR)
4. Son (Age: 7 years, Born in UK, having ILR - expiring on 05-02-2020)

Due to a family tragedy, my wife and son had to leave UK for an year. Below is their date wise absences from UK:

1. Wife and son: Left UK: 26-Aug-16, Entered UK: 28-Jul-17, Absence in Days: 336
2. Wife and son: Left UK: 04-Oct-13, Entered UK: 13-Dec-13, Absence in Days: 71
3. Wife only: Left UK: 01-Jan-11, Entered UK: 24-Jan-11, Absence in Days: 24

TOTAL ABSENCES IN DAYS: 431

I have below questions to you - kindly advise:
1. Do they qualify in terms of absences to apply for the naturalization?
2. If yes, is UKBA going to ignore the additional absences? Please also give any other info.
3. If no, when can they apply? Is there a easy way to get my son's ILR (BRP) renewed?

The absence limit doesn't apply to children. As your son is UK born, he has an entitlement to register as British until the age of 18. Your UK born son did not even need to apply for ILR either.

Thank you for your reply, my son was was born in UK before the parents getting theirs ILR. we wanted to go India so applied his Indian passport at that time.

What you're being advised is that you could have registered your UK-born son as a British citizen anytime after you got ILR and before the age of 18.
