BC application with passport and Brp in different name

Hi,

I hope I can get some guidance...
I have received my ILR this year. My passport (the one i used for my ILR application ) expired shortly after i received my ILR and i applied for a new one with my husband's name.

I qualify for BC and i would like to put an application forward but I am wondering if i can submit my new passport with my changed name (husband s name) and my brp with my maiden name or if i have to update my brp first?? (£229)
I understand that if there s a change of name, brp must be updated within 3 months or risk a fine or shortening of stay???
My 3 months "grace time" is coming to end shortly and i am not quite sure which way to go.

My other question is will the Home office retain my current passport while considering my BC application?

You will not face any issues and there is no need to update the BRP.

NO. You don't need to submit original documents with the new online applications. You only need to scan and upload. You then bring all original passports for checking when you attend your bio-metrics appointment with UKVCAS and YOU retain them.
