Visa for Baby - a parent on ILR - travelling to India urgently

Hi @CR001 and experts,

I would like to ask for your expert opinion on my child's visa for immediate travel.
Here is my situation:
I have received ILR (job under Shortage Occupation List) on Feb 2020 (on 18th).
Wife under Tier 4 student visa expiring on Aug 2020.
Baby born in the UK before my ILR.
We would like to travel to India in the beginning of March which we can't miss.

I have 2 options A & B:
A. Apply for British passport for the child, via MN1 form. I thought this route takes time as MN1 would take 3 weeks to process.

Is there any priority/quicker way to get this before March?
If no, after our return from our trip, we will do this anyway.

B. Making my child as PBS dependant under Father on ILR (or) Mother on Tier 4 student expiring on Aug 2020.
If I go with these options, would I have to pay surcharge for baby born in UK?
Should we have to show the maintenance funds for baby born in UK ? 645£ for 3 months or 1 month?
Can employer show a letter instead of maintenance funds?

Can the baby still apply for MN1 and British passport if in dependant visa without any restrictions?

MN1 registration takes between 2 and 6 months. Not sure why you believe or where you heard it takes 3 weeks. Note that MN1 is NOT a passport application, it is an application to register your child as British.

Best option to apply for tier 4 dependent visa.
You have to pay IHS
You need the maintenance funds
No you cannot use your employer letter to prove maintenance as you hold ILR.
Can the baby still apply for MN1 and British passport if in dependant visa without any restrictions?
A UK Born child can apply for MN1 at any point until they are 18 years old.

Hi experts,

I just recently received ILR. I have a British born 10 months baby currently in UK with me. We are planning to go to India next week for 3 weeks.

My question is while the baby is in UK, Is it possible to apply for MN1 form before we leave UK and give the biometrics in India ? If we apply MN1 from India we can only make the application after 11th March. We are trying to save processing time on MN1 and get the British passport quicker.

He would need to enroll biometrics within the UK.

Could you please clarify on these below thoughts:
I can apply MN1 from India, give biometrics in India and then get the British passport from India.
I can still provide UK referees for MN1 application in India?
I've heard there is no priority application for British passport from India. Can you please confirm?

How long are you planning to stay in India ?

I will return to UK in 3 weeks. But my wife and baby will stay in India until they get MN1 and British passport for my baby.
