Hi All,

I have a confusion on when can I make my application for Naturalisation.

I have got my ILR on 20/1/2020.

In the last 12 months I was away b/w the following dates.
04/03/2020 - 26/03/2020
23/07/2020 - 16/08/2020
15/09/2020 - 06/10/2020
02/11/2020 - 22/12/2020

I was not aware of the rule that I cannot stay more than 90 days outside UK, in my head it was 180.

Looks like a math problem. 17Aug21 would be my suggestion if you don't exceed the 90day absence till then.

04/03/2020 - 26/03/2020 -
23/07/2020 - 16/08/2020 - 25 days
15/09/2020 - 06/10/2020 - 22 days
02/11/2020 - 22/12/2020 - 51 days
Total number of days outside UK in the last 12 months 98 days.

I read the guidance and was confuse as it says;

Absences from the UK during the last 12 months of your qualifying period will be considered in the following way:

Normal permitted absences in final 12 months of your qualifying period 90 days.

Total number of absences normally disregarded 100 days.

Given the time frame above I'm 8 days over the allowed absences, however not sure what it means by disregarded absences which is 100 days.

Can I still apply if this 100 days cover me as due to COVID my flight was cancelled few times and I had to stay longer.

100 days disregarded Absence in the last 12 months

As I read it "disregarded" means they are not bothered about up to a 100 days, you wouldn't have to ask for caseworker "discretion", though it can't do any harm to explain why you are over the 90 days limit.

So if I apply with 98 days absence it should not effect the decision... ? I have got a clean history and have no other problems with to fulfil the requirements for Naturalisation.

Hello, I got have done the calculations again for number of days I stayed outside based on the information I received from my friend that when counting days outside UK, we don't have to count the day we travelled in such way I am 92 days which is 2 days above normally 90 days.

Can any experience moderator kindly suggest if I can apply for my Naturalisation as the guideline suggest that upto 100 days absence is disregarded.

Hope to hear soon.

92 days is no issue at all - if the Home Office UKVI official guidance says up to 100 days is disregarded then we must take them by their word.
Occasionally members have reported over a 100 days with explanations and got approved.

Hi Gurus/experience moderator,

Kindly see my query and reply me, I'm not sure if I'm 98 days or 92 days absent in the last 12 months, but I'm sure I am less than 100 days. What are the chances that my application will not be rejected. As I mentioned above my final trip was originally planned to return two weeks earlier however due to Covid 19 test being positive for my colleague who I was sharing the apartment I have to stay additional days and I have the proof of tickets. Would this satisfy the Case Worker or should I wait for the time of absence to be less than 90 days which in my case will be in August.
