Hi, Can we apply for naturalization for the child in order to enable for British passport and both the parents can continue to remain on ILR? We have already completed more than 1 year requirement on ILR but want to apply the citizenship only for the child. Could not find any specific guidance so any insight will be helpful. Thanks!

Yes, you can apply, it is quite a recurring situation. The rules do change depending if the child was born in the UK or not. If you explain more about your circumstances users here will be able to advise better.

How old is the child? Born in the UK? Born before or after gaining ILR?
Note children are registered as British - Form MN1 - Guidance:

This is quite a common application - just for the child is ok.

thanks for prompt response!
Child born outside of UK and 12 years old. Have ILR since 2021. I thought MN1 was to be used only for children born in UK, which I had used earlier for my other younger child who then applied for British passport.

MN1 is for all minors (under 18s), irrespective of their immigration pathway.

From MN1 guidance, would section 3(5) apply in my case ? If so it states that parents are British by descent which is not the case?
section 3(5) birth abroad to parents who are British by descent but are now
living in the UK or a qualifying British overseas territory

Hi, one more question, do we have to submit the original foreign passport and ILR at the time of MN1 biometrics submission or will it be returned back on the same day?

You scan and upload copies of your documents - no originals will be retained. Passport is only for ID purposes, at the appointment, it will be returned. Also note UKVCAS staff are not UKVI caseworkers, they won't give advice.

Thanks again! As we were planning to travel in the meantime if the MN1 processing takes a whole 6 months.
