Got really great advice here but due to some other life (financial) matters we did not get around to applying.
I still have the old application filled in etc.
Looks like I can still use this despite being a year old, it just asked me to add some extra details around expired BRP cards.
But I believe some of the rules have slightly changed, so just wanted to double check here before paying nearly £2.5K

Kids' Status:
Child 1:
Age - 8 years
In UK since Feb 2018 (i.e. travelled as soon as visa was granted).
Got their ILR in April 2022. Long absence from UK between April 2022 - Feb 2023 (was with mother when she was having the 2nd child).

Child 2:
Age - 3 years
In UK since Feb 2023 (i.e. travelled as soon as visa was granted).
This child has ILE which I believe is as good as ILR for all intents and purposes.

I am a naturalised British citizen and the mother has ILR since April 2022.

Looks like its still okay for us to pursue Section 3(1).
Just wonder about this clause - "the child has been resident in the UK for the last 2 years"
My daughter is just 2 months short. Should we wait for 2 months?

As your child is just shy of being 3, I would recommend waiting, only 2 months to wait are probably worth the extra peace of mind. application costs are unlikely to go up until April, so not much to lose. Best to wait for 2 months also for eldest child, as both children need to have spent the last 2 years in the UK.

Apologies, looks like my question itself is invalid.
They have both been in the UK since Feb 2023, which means they have been here for more than 2 years (bar the odd few weeks holidays in EU/India).

I guess that would mean we are ok they them to apply?
I got confused with my wife's requirements which insists on her physically being present in the country on this day 3 years back.
I guess for children there is no such requirements?

I could wait and apply for them together in Feb, but helps to spread the cost across months, its not cheap

Yes you can apply now for both children. No requirement of having been here on the day 3 years back. You can choose how/when you apply for each person across months.
