Hello,
My husband has a work permit status since March 2007 and is a salaried director working for his own company that employs 18 British nationals. Is he eligible to apply for ILR earlier than 5 years or he has to wait till 5 years are completed?
Thanks.

People with leave to enter/remain as WP holder need to complete a residential qualifying period of 5 years before becoming eligible for ILR.
Application for naturalisation (citizenship) can be made after 12 months of being granted ILR.

That is under current rules but they will probably change again by the time you apply and (and best) there will not be PR after 5 years.

If earned citizenship laws are introduced before the OP's husband becomes eligible (and applies) for ILR, he will have to apply for probationary citizenship as per residential qualifying criteria defined in the earned citizenship laws.
The labour government had announced July-2011 as the implementation date for the new laws. Let's see if the current coalition sticks to the plan or not.
regards

I am just wondering, How come one can have own company when they are on WP? I think that the WP holder cannot setup any business in the UK. Can anyone clarify this?

Whats PR got to do with OPs query? PR is issued under eu regulations. Its ILR which is relevant in OPs case.

I wondered that, WP is tied to sponsoring employer which cannot be urself!

Its actually possible. Company law comes into play here. Long story though....
Was easy when the employers didnt require sponsorship license. Almost impossible to do now.
