Naturalisation..

I am posting this query on behalf of my close friend.

Her husband is holding ILR valid from last june and he is eligible for naturalisation on this year july.

His wife and son is holding 24 months settlemnt vias currently there are in Mumbai.His wife came to UK on March 2006, she will complete 5 years on march 2011 but she had lot of gaps due to long visits to India.

Can she include her son (1 year old) visa along with his husband naturalisation application, or he should complete 2 years before applying for naturalisation.

How about 3 years qualification period as a spouse of british citizenship, can she count the period before his husband naturalisation or the 3 years clock will start after her hubby naturalisation.as of now she crossed 450 days leave in her 5 years stay.please help ...

Before anyone can apply for naturalisation - they must have ILR themselves.

Naturalisation (as a process) is an individual application and each application happens on it's own merits - so the wife will have to qualify in her own right first.

That means having ILR - which she (apparently) doesn't yet.

IF she applies for (and gets) ILR before or once he's a british citizen, then she can use the 'spouse of british citizen' route for naturalisation which removes the year wait from the requirements - but still has the other residential requirements (e.g. she must have been in the country exactly 3 years before application and avoid the absences totals).
