Hello,
Experts on this forum, please help. I apologize for the long post and if the same information is available else where. I did search other threads for info, but couldn’t find much regarding MN1 application queries for child born outside UK.
I and my wife got ILR after completing 4years of HSMP(JR) in jan 2010. I am eligible for naturalisation from 10 feb 2011. My wife decided to remain as indian citizen with ILR.
My son was born in india in SEP2010. I applied for his settlement visa with British deputy high commission in India in the last week of Dec 2010 and it is still in process (BDHC in india now takes 50 working days to process!!).

I need your help in filling the MN1 form for applying naturalisation for my 5month old son born outside uk. I am applying for my naturalisation along with him. My wife is not applying for naturalisation along with us.
Please help me with my following queries:

1.1 Section of the British Nationality Act 1981 under which you would like the application considered

Section 3
PARENTS’ RESIDENCE IN THE UNITED KINGDOM OR THE BRITISH OVERSEAS TERRITORIES, WHERE APPLICABLE
3.1 Please say which parent is the one who is a British citizen by descent and on whom this application is based.
Mother/ Father

I am not a british citizen at the time of application. What should I write here?

3.2 Please provide the above parent’s addresses in the United Kingdom or the British overseas territories during the reckonable three year period.
What is reckonable 3 year period here?

3.4 Please provide details of the other parent’s addresses in the United Kingdom or the British overseas territories during the reckonable three year period (if different from 3.2
3.5 Please give details of all of the other parent’s absences from the United Kingdom and the British overseas territories during the reckonable period of residence above. If necessary, please continue on page 13 of this application form.

My wife went to India for delivery on 10 june2010. It took a long time to get Indian passport for my son(4 months) and now awaiting settlement visa for my son
Her absences are 326 days
She first arrived in Uk as HSMP dependent on 26/10/07. Converted to ILR on 15/01/2010

Absences:
April 2008; 13 days
Mar 2009 : 13 days
Aug 2009 2days
Sep 2009 2 days
Absent in UK since 11 june 2010 to 1 April 2011(Tentative date): 294 days
Total absences: 326 days

Will this be an issue for my son’s natuarlisation application?

Section 5: Referees and Identity
My previous landlord(British) agreed to give reference(Non-Professional) for my son once he arrives in UK
I don't think I can get a professional reference for him as there won't be enough time to register with /convince health visitor to sign his application.
Can I get the paediatrician in India who looked after him to sign his application as professional referee? Can anyone professional(UK citizen) sign his MN1 form? Like a staff nurse or doctor who is not involved in his care but for just identity purpose.

Thank you very much for your help in advance.
With regards,

Note that child is applying under section 3(1) of the BNA1981.

If the application is in respect of a child born abroad to parents who are British citizens by descent under section 3 (2) or 3 (5) you should complete this section. Otherwise go straight to Section 4: Good Character.
Therefore, Section 3 of the application form MN1 is not applicable.

See also Guide MN1 > SECTION 5: REFEREES AND IDENTITY.
