Hi All,

I have a question to ask you concerning UK nationality for my mother. My Mother was born before the British Nationality Act of 1948. She had immigrated to Canada in the 50s using a British passport (Jamaica being a British colony at the time). My Mom got her Canadian citizenship before Jamaica's independence. My question to you is of two folds.

1). Is my mother entitled to UK citizenship because of this (keep in mind she never got a Jamaican passport after her independence)? Also my mom never renewed her British passport and eventually misplaced it. The only proof she has of her ties with Jamaica is her birth certificate

2) Would I be entitled to UK citizenship through my mother? I am a naturalized Canadian. I got my Canadian citizen when I was a child. I was born before Jan 1st 1983.

Normally, a person born in Jamaica before independence became a Jamaican citizen on Independence Day.

And normally, such a person lost British nationality automatically.

The normal exception would be if your mother's father or paternal grandfather was born in the UK or a place which remained a colony - does that apply to your mother?

thanks for your reply..No this does not apply to us.I am confused because i called a couple lawyers in the UK and was told that my mom could get british bationality based on what I wrote in the forum.

I am not willing to spend 300 pounds plus lawyers fees to find this out unless I am absolutely sure. Thanks again for your post.

Perhaps the lawyers know something else ... did they put their advice in writing?

Or maybe they want my business. I did not get anything in writing. The lawyer wanted me to wire the fees then take it from there. i get this feeling if HO declines our application the lawyer would want extra money for a re appeal..I will just take your word for it..
