We as a family(3) were granted ILR in April 2010. I am hoping to apply for naturalization after the one year period. I was wondering if my husband also will be eligible to apply at the same time or does he have to wait till OCT 2011?.

He was on a student visa from Aug 2006-Oct 2008- married Dec 2006
and on a dependent HSMP and Tier one visa since October 2008- Apr2010(issued ILR).

I figured student visa's would not count (correct me on that!!)Will the 3 year qualifing period be till October 2011- that will be 3 years. or can he apply with me.

Your spouse may apply for naturalisation through either of the following routes:
Route 1 - Complete 5 years in the UK and upon fulfilling standard requirements apply for naturalisation.
Route 2 - After you are granted British citizenship (naturalisation certificate), your spouse may then apply for naturalisation as spouse of British citizen as and when requirements for spouse /civil partners are met.

Time spent in the UK in under any legal immigration status may be included in the qualifying residential period for naturalisation.

Thank you for that..I had read that from one of your previous posts..From that 2nd point what I get is...He then cannot apply unless I have got british citizenship first. Am I right in thinking this?

thanks for the reply

Apply together 5 years after his initial arrival (August 2011?). i.e. When you both satisfy the standard requirements.
