I received my ILR on basis of married to a person Present and settle in UK.

My spouse is still on ILR from last 10 years. Does my spouse need to British Citizen first then I can apply for British Citizen.

If I am not staying with my with my spouse can I still apply for British Citizen after 12 month of gaining ILR.

You may apply for naturalisation as and when you fulfil the standard requirements, irrespective of your spouse's status or your relationship with her / him.

Thank you very much for such an insistent reply.

I came in UK on a spouse visa in March 2008.

I have received my ILR in October 2010 and now in March 2011 it will become three years I am in the UK.

Can I apply for Naturalisation after March as it become three years I am

in UK or do I need to wait 12 month more from time I received my ILR stamp.

If your spouse doesn't have British Citizenship you'll need to have 5 years of legal residence in the UK before you can apply for nationality....not 3.

Click on the link above to read / understand what the "standard" requirements for naturalisation are.

If you wish to apply for naturalisation as spouse of a British citizen, then see requirements for spouses and civil partners.
