Child passport expired - MN1 application under section 1(3)

Hello, Someone Please help us
Going to apply MN1 for my 6yrs old boy through MN1 under section 1 (3),
Born in UK before we have got ILR, he got Indian passport, which is expired
Sept 2009, But at the time of ILR the case worker insist to get ILR for my child also, he got it but no body noticed passport expired.
Is this ok to apply MN1 through NCS.
