Hi,

My father is granted ILR after I am born in the UK and I have lived there ever since. Will I be entitled for an adult (over 16) British Passport. In this case, will I need to be registered or naturlised?

Furthermore, I am currently abroad in Turkey and could I apply for the British passport from here, even though I am currently residing in the UK?

Yes, that's correct. I have my foreign Turkish passport and it does not have the ILR stamped for my return to the UK. The immigration officer is not satisified, he won't let me through.

When were you born?
When was your father granted ILR?
Is your father a British Citizen? If so, when did he naturalise?

I was born in the UK on 07/07/1992. My father was granted ILR on the 22/08/1994. My father has the ILR stamped on his foreign Turkish passport but he never held a British passport he was 'settled' in the UK when I was born. I think he has been naturalised - i'm not even sure.

As you were born after your father gained ILR, you could have applied to register as British Citizen before the age of 18. As you are over 18, you will need to apply for naturalisation as British Citizen on your own rights. The application usually takes a few months and if granted, you can later apply for a British passport.

What is your legal status in the UK? Have you got ILR? If you hold ILR, you should be allowed to travel back to the UK.

Hey, couldn't I apply through the T - Application, registration as a British citizen:

'How a person born in the United Kingdom can register as a British citizen if they lived there up to the age of 10, using application form T.'

''The requirements you need to meet

To register as a British citizen you must:

have been born in the United Kingdom; and
have been born on or after 1 January 1983; and
be 10 years of age or over; and
have spent no more than 90 days outside the United Kingdom in each of the first 10 years of your life.''

My legal status in the UK is that i'm a British national and i'm settled there. However, I don't have the ILR stamped and i'm not sure how I can get it stamped in Turkey - may be the British Consulate or UK border Agency? Surely, there must be a way I can get it stamped, because it's probably the only way out.

If you are a British national then you are already a British citizen!

I belive I'll have to register first, I'm just legally status there.

Is there anyway for me to get my ILR stamped. As long as I leave Turkey, I can register and apply for the British passport there.

Did you have a ILR sticker in the past (in an expired passport)? As you were minor when you father have gained ILR, do you know if he applied for ILR for the rest of the family at some point?

Did you ever leave the UK before? If you did, how did you enter the UK in the past?

You're entitled to register, if you had spent your first 10 years of your life in the UK.

I do have my expired old Turkish passport it doesn't have an ILR sticker, though.

Yes, I have left the UK many times in the past around 3 times, in 1993, 1998 and 2007. And I did manage to travel at that time without hindrance. I do recall something about mine being under my mother's passport when I was a minor.

Yes, since I was born I have lived there more than 10 years - my life was always within the UK.

If you have proof, then you may apply for registration via the consular section at the British Embassy (since you are not in the UK).

Yes, I have all of my documents birth certificate etc. with me, this could possibly be an option.

BUt how I can go to the UK without doing this?? Should I apply for a visa or something?

When you travelled in 2007, did you travel with your own passport? Without any visa / ILR in it? How did you get back into the UK? Did you (or your parents) ever apply for ILR for you?

Hey, Jambo

My parents from the UK found my ILR letter from the Home office with my name and DOB, which states I have ILR. And in my old minor passport next to the 2007 entry to Heathrow there's a refrence to the ILR letter.

I got the plane ticket for this month on the 24th, hopefully with the letter and my old passport with the new, I can fly back to the UK.

If necessary (problems with boarding airline), then follow UKBAbble's advice.
