7 year old daughter's British Citizenship

Hi,

I just got ILR couple of days ago and need to apply for my 7 years old daughter's british citizenship who was born in the UK. I left her with my parents since the age of 10 months when I got seperated from my husband in 2005 and came to the UK with my son (now 14 yrs old) to complete my PhD that I was persueing at that time.

Her father is living in India though have no contact with the child. He filed children custody case in 2007 and I got stay order on that at that time and the case is still under saty order from last 4 years.

I need to know if there are any complecations in getting her citizenship because of that even though it is an entitlement.

The MN1 form requires a consent from both parents or the parent responsible for the child. In any case, not having consent is not a reason for refusal as this as you mentioned is entitlement under section 1(3).

Thanks for your reply.

I am wondering how important is it to give the reason why you can't provide the consent of the other parent?

I am applying via a solicitor and have been asked by her to provide the details of Indian family law about the situation. Just wondering if It is necessary to explain all this in there.
