Applying for MN1

Dear All,
I am soon going to apply for my sons MN1 registration.
we recently got ILR last month and my boy was born in the U.K. He is now 3.5 years old having an indian passport but his Leave to reamin has expired.
Also we changed his forename recently and got the new birth certificate. It also mentions about the old forename. we also put an ad in the local newspaper. My questions are:

1. Can I appy for his MN1 registration using the new birth certificate alone? Even if I send his Indian passport now his forename is different.
So can I apply for his registration using new birth certificate and Local advertisement.

OR

Do I need to get a new indian passport with the forename changed and then apply for MN1. I dont know whether I need to send my sons Indian passport when I apply for MN1 registration. Kindly let me know the quickest way to solve this.

At what point of time I have to inform the Indian authorities of the name changed? I am confused about this. If I dont get his name changed in the Indian passport would that be a problem when I surrender his Indian passport and apply for his PIO card

My ultimate plan is to get a British passport for him and then get PIO card as he was born here. Kindly let me know the way in which I could save time as my boy needs to travel to India in another 3 months with British passport and PIO card.

There is no need to get a new Indian passport for the registration application. Just explain in the Other Information section on page 13 about the name change and use the new UK Birth certificate. No need to send the ad from the newspaper.

Please note that nowadays it can takes 2-3 months to get approval for registration + 2 weeks for British passport. I don't know how long it takes to surrender Indian passport and apply for PIO but doing it all in three months might be tight.

Thanks for you reply. So can I apply for MN1 registration without a Indian passport? Also can you tell me whether do we need to send parents original Indian passport with ILR for MN1 registration. I am asking this because my passport has been sent for claiming benefits. Kindly let me know.

It would be helpful if you would also let me know the dcoments to send in original for MN1.

If the child doesn't have a passport, you can apply without one. There is no requirement to have a passport for a UK born child applying for registration under section 1(3).
You will need to show (to NCS) or send (if apply by post) the parents passport to prove they were granted ILR.

Hi, Thanks. But in my case we have a indian passport for the child but the forename has been changed recently. so what would you recommend. Do I need to amend the name in the Indian passport first or Can I apply for MN1 with the new birth certificate and newspaper ad. My child was born in the uk only but have a passport with the old name.

Also do we need to send both the parents passport with ILR as my passport is currently sent for claiming benefits. But I do have a photocopy of my ILR copy and my partners passport.

As I said in my original post, send the existing passport + new UK birth certificate + explanation about the name change in the "other information" section on page 13. No point sending the newspaper ad.

You will need to send original parents passport with ILR. Not a photocopy. So you will need to wait until you receive your passport back.

Not really. Original passport of the parent signing the MN1 form is required which will be one of the two. Other's parent passport is not mandatory.

I enclosed my wife's passport as she signed the form and sent the copy of my passport with ILR stamp and photocopy of our marriage certificate. I did not use NCS.
