MN1 Registration for my baby

Myself and my wife have got ILR last year (Dec 2010). My baby was born in India (After we have got ILR). She has got the settlement visa for entry.

Visa Details:
Type: “Visa Settlement to Join parents XXXXXXX”
Observ: Indefinite Leave to enter the UK
Valid from XX/XX/2011
Valid Until: XX/XX/2016

I have been told by the HO contact center that she has the visa with the expiry date (Valid Until) and she is not eligible to apply for MN1 registration. However, the nationality checking service requested me to book an appointment, as there is wording “Indefinite Leave” in the Visa.

I am totally confused. Could somebody shed some light on this Pl ?

She has been issued with ILE (Indefinite Leave to Enter). ILE is issued in line with the date of expiry of the applicant's passport.

You may apply for her registration as British citizen under section 3(1) at the same time as either parent's naturalisation application.

ILE is exactly the same as ILR except it is issued outside the UK. The expiry date only means that she has to enter the UK for the first time before that date.

Any baby born in the UK after you get ILR is automatically a British citizen.
