My wife Tier 1 General visa and I am holding Britishcitizen

Hi,
I just got my british citizenship 2 months back i.e NOV 2011 and I got married in Dec 2011, now wife is already in UK on Individual tier 1 general visa, i.e Expiring in Aug 2012, can she apply for ILR? or we have to live together for 2 years before she apply for ILR? Let me know what are the other options available?

As she is not your dependant, she can apply for ILR when her Tier-1 requirements are met.
The 2 years period is relevant if she was on a spouse/PBS dependant visa, which she is not.

sorry I meant to ask, can she apply ILR On my basis?
Her tier 1 general visa exp in Aug 2012 but then she need to apply for extension, so I was thinking rather than applying extension can she apply for ILR straight on basis of my British citizenship?

Thanks for replying.
I have read your post. what you mean by "she can apply for ILR when her Tier-1 requirements are met"??
Does it mean, she should do her normal extension now and apply for ILR when she complete her 5 years duration.
or apply for ILR stright when her visa due to expire on basis of me.
Sorry but just trying to be more accurate here, before applying.

it would also be possible to switch using form FLR(M) and then apply for ILR after two years which would probably be quicker.

hey Greenie,
But the rules under FLR(M)- Family immigrant may (or may not) change from this april 2012 from 2years to 5 years then she would have to wait for another complete 5 years to get her ILR done.
Even if she converts her visa now on FLR(M) she anways needs to wait for 2 years to show as their cohabitation proof. And the extension is also for 2 years now so it makes sense she stays on her Tier 1 G visa and get it extend and get her ILR seperatly.
Correct me if i am wrong?

You should not be posting and trying to make a decision for someone elses wife. They need to find out the information and make decisions for themselves.
