Hi,

Due to some urgent requirement, I will be travelling to India the same day I get my British Passport, (ie., using my Indian passport for travel).

Can I surrender my Indian passport and apply of OCI while in India? Will my stay be legal once I have surrendered my passport ans awaiting the result of my OCI status?

To answer your question - it is an offence to hold Indian passport more than 3 months after acquiring a foreign nationality. Travel each time with an Indian passport will attract penalty.
