ILR - Dependants in India

Post by rganeshsai » Tue Apr 24, 2012 7:49 am

Hi,
I'm due to apply for ILR in Aug-2012 and my wife has been resident with me in the UK from Aug-2007 to Feb-2012 under dependant visa. Now she has moved to india with the children due to family commitments. The children were born in the UK so I understand I can register them as BC from India once im granted ILR however my question is -

1> Can my wife apply for ILR from India once Im granted ILR or does she need to be physically present in the UK to apply?

Any help please ?

No, she cannot apply for ILR from India. Once you're granted ILR, she may apply for a spouse visa.
