Chances for ILR?

Post by tropicalforest » Thu Jun 14, 2012 11:54 am

Hi,

Can some one advise me on my chances on getting an ILR - given some complications in my case.

- Entered UK on WP in June 2007
- Got HSMP Jan 2008
- While processing my HSMP extension under Tier 1 General, my application was refused for lack of maintenance funds in Jan 2010
- Appeal to the immigration tribunal but it was refused in May 2010
- So left UK in Jun 2010, got a fresh tier 1 visa and came back in early August 2010 - well within 90 days period
- There was a policy revision in June that allowed HSMP extension for those refused for lack of maintenance funds. So I applied to under that policy decision and received new Visa.

My understanding is - I was lawfully in the UK during all my stay (though technical gap exist between Jan - Jul 2010). Since my application under policy document that allowed HSMP extension - the gap should not be counted.

I am due for ILR shortly. IS THERE A GOOD CHANCE OF GETTING an ILR?

REgards,

I am now back on tier 1 and following intervention by my MP, have recd a letter from the UKBA that I have continuous stay for 5 years and that any gap overseas arising from the switching application has been regularised, that is, no gap in leave to remain. I intend to add thee UKBA documents to my application.
