Hello forum members,

My husband is on tier one general visa we got married in January 2011 and i came back uk with my husband with out changing my visa...
I applied for dependent visa in Jan 2012 and got entry clearance.

my husband is applying in Nov 2012 for his ilr.
we both living together since jan 2010 till date on different visa but we can show council registration letter and voting cards,bank statements ..etc to till date on same address.

we are worried will this period count towards getting ilr for dependent applicant or period will start from marriage date or from when i got dependent visa of tier one general.

its really confusing me .please guide me on which application form i need to apply according to new rules


I would appreciate for any help

Living together does not count if you were on your own independent visa. So that residence is wiped off for ILR purposes.

Your residence will count from the date you entered UK on the visa that you obtained in Jan 2012.

could you please tell me which allpication form i need to fill
FLR(M) or FLR(O)..?
we will affect with new 5 years rule or not..as u said my period will not count towards living together ...?

You will not need to meet 5 years requirement. But there is another good news for you. But I won't tell you until tomorrow. Keep guessing :)

First of all, I must say that my initial advice may not have been very accurate, and that your residence with your partner before the marriage may be counted, if you can prove that you were living together.

But that issue is not really of importance now.

And the important bit is, that being a dependent of PBS migrant, you will be eligible to apply for ILR with you partner, regardless of how long you have been on dependent visa.

Your problem solved, no more waiting games. :)
