I'm sorry to pull this up again as this has been discussed a zillion times before but even after extensive search I just could not find a concrete answer.

A friend of mine going for ILR based on HSMP+Tier1 Start of May 2013.

Pay period she would go for is divided into two sets due to maternity leave.

Set 1: 29 August 2011 - 28 April 2012 (8 Months)
Set 2: 01 January 2013 - 27 April 2013 (4 Months)

Now the actual part! She gets paid on last Wednesday of each month which means on 31st of August 2011 she received a pay (obviously for the month of August).
Question is, Can she claim that salary as it was paid within 12 months pay?
If she can then she'd effectively have 13 payslips during that 12 months period.

Pay dates with start end dates are as below (please note that there are 13 pay dates but they fall into a 12 months period due to awkward 'last wednesday of the month rule')

Period 1 Start date: 29 August 2011
Wednesday the 31 of Aug 11
Wednesday 28 Sep 11
Wednesday 26 Oct 11
Wednesday 30 Nov 11
Wednesday 21 Dec 11
Wednesday 25 Jan 12
Wednesday 29 Feb 12
Wednesday 28 Mar 12
Wednesday 25 Apr 12
End date: 28 April 2012

Period 2 Start date: 01 January 2013
Wednesday 30 Jan 13
Wednesday 27 Feb 13
Wednesday 27 Mar 13
Wednesday 24 Apr 13
End date: 30 April 2013

I personally believe that she can but would love to have seniors commenting on this.
I hope I'm clear enough in asking the question and as always, thanks in advance.

I get paid 25th every month (if 25th fall on week end then earlier friday). I have claimed full month like 1st January to 31st October). CW did not bothered.
If some one pay is monthly then always go for full months date ie on this case go for
Set 1: 1st september 2011 - 30 April 2012 (8 Months)
Set 2: 01 January 2013 - 30 April 2013 (4 Months)
which date you are paying is not important.

She can't (because of maternity leave starting on 29th of Aug) and quite frankly she wouldn't mind using the dates specified as it gives her an extra wage unless it was against the rule.

salaried earnings always based on months or specic dates (Say 3rd to 3rd next months) . On this case earnings is comming for full monthly earnings. You are claiming months Sep 11, Oct 11, Nov 11, Dec 11 ,Jan 12 , Feb 12, Mar 12 and Apr 12 98 months). You can not include 29 August salary because that will count as another month (August ) earnings.
