ILR AT PEO WITHOUT DEPENDANT

Respected Board Members,

Just need an advice about My ILR,

I got TIER 1 (General) in June 2008 and my wife joined me in UK in October 2009 as TIER 1 dependent.

I am planning to attend PEO in person with in couple of week without my dependent as I have got Court Fine and I am not sure I will sail through or not. My query is,

Can my wife apply ILR later on by post or PEO AFTER I get my ILR as our visa is valid till July 2013.

Please guide me in this specific scenerio. Thanks every one in advance.
