Advice regarding wife and steps sons ILR application.

Post by chela » Mon May 20, 2013 12:07 pm

Hello, I would appreciate pointers on the following points:

I am a British born UK National. My wife and step-son are from Latin America. They successfully obtained a UK settlement visa in oct 2011.

1) I would appreciate any advice in any supporting documentation to accompany the ILR?

Should I re-use/recycle supporting documentation used in the settlement visa?

When we applied for my wife and step sons (settlement visa) in latin america it seemed worthwhile to pay an immigration advisor around £800 +. This was because my step sons biological father had not been seen since the pregnancy and had not communicated in anyway and hence the advice regarding an affidavit confirming the bio fathers absence/non existent support seemed sensible. However now stage 2 (ILR) is approaching, I believe this should be almost open and shut case as my wife has now had my daughter (born jan 13) and we are happily married in our owned home and financially stable with and I have a good salary. My wife also works for my own LTD company. Therefore £500 + VAT for advice to complete the ILR seems step?? - as I figure it's trivial decision in comparison to a settlement visa. Therefore, I intend not to pay for advice for this application (unless its reasonably priced)......

2) child benefit - I have claimed this for my son (step son) who is my dependent on a settlement visa. Although child benefit is a universal benefit (most people are entitled to this until very recently) and it is not my wife claiming so I'm slightly concerned this would have a bearing or influence.... thoughts?

3) After ILR (stage 2) what is the process for applying for a british passport? Is there a third stage application (i.e. british citizenship application )?

Many Thanks
