Tier 1 G extension, when ILR is refused or delayed

Hi Guys,
I'm eligible to apply ILR. But not sure if I can supply employer letter for my long absence of 166 days in a year at a stretch because that is my ex-employer. However, I would like to take a chance and apply in person at PEO. For some reason, my ILR refused I can always apply Tier 1 G extension as my visa would still be valid then. But, if PEO don't say anything on the outcome and retain documents for some checks or something and God forbid! if it got delayed, without my documents can I apply for Tier 1 G Extension? How to deal with this kind of situation? Experts please advise.

Also, I'm going to apply Tier 1 PBS dependent visa extension for my wife at the same time I apply my ILR. What happens to this outcome if ILR is delayed and refused?

Firstly you are creating a hypothetical situation that you then want advice on. Apply for ILR if you meet the criteria. Current criteria is 180 days in an year outside UK mean trouble.

You cannot apply two visas for yourself at the same time, like lottery. While your application is being considered your existing T1 G will auto-extend.
If you want to apply for T1 G, ask for your ILR application to be withdrawn and documents returned.

I know I can't apply for two visas like a lottery (though I wish so ). I was stating I could apply for Tier 1 G Extn ofcourse as a different application.

Can you please advise on PBS dependent visa extension? If I withdraw my application, can I still apply for my wife dependent visa? or we can only apply for this visa provided I got ILR or Tier1 G Extn?

You may make multiple applications (3.1), provided they are made before the expiry of your leave.

Subject to the associated application fees as well.

Sorry, but I don't think I got the answer. Both myself and for my wife Tie1 G and dependent visas are valid till Dec 2013. If I had to apply for ILR and PBS dependent for my wife at the same time at PEO say in this month (yes, because she didn't complete 2 years yet to apply on SET(M)), regardless of my ILR outcome, can she get her dependent visa extended? Or will it be dependent of my ILR visa outcome? If my ILR is negative, what would she get? If my ILR is delayed or made as a postal application at PEO, what would she get? Please advise.

If your application(s) is(are) refused, then she would also be refused. Her application is dependent on the outcome of your application(s). You may ask for her application to be decided after yours.

hi vinny I obtained my ILR through 10 years long residency and it has been approved on 17th of June 13.

Now i am waiting for my spouse FLR(M) which was posted on Jan 26th 2013.

can my spouse immediately apply for ILR through set(m) after flr(m) or need to wait 2 years ?

spouse entered UK in 2005 on student dependent and last visa was PSW dependent ?

so can i assume that spouse has already spent 2 years as dependent, so going for set(m) is correct option ?
