ILR 3 months concession confusion and absence calculation

ILR 3 months concession confusion and absence calculation

Hi All,

I am bit confuse on how 3-month entry concession work for ILR. I've read FAQs Q4 but unable to understand meaning of the concession period. My details are:

Category: Tier 1 (General)
Visa granted: 16-Oct-2008 valid till: 16-Oct-2011
First entered in UK: 3-Dec-2008
Visa Renewed: 23-Nov-2011 valid till: 23-Nov-2013

Based on above information I fall under 3-month entry concession. Question is does my ILR clock starts from 16-Oct-2008 or 3-Dec-2008? Earliest date when I will be eligible to apply for ILR?

Second question is regarding absence calculation, details are given below:

Trip 17-feb-2012 till 2-mar-2012: 14
Trip 26-aug-2011 till 11-sep-2011: 16
Trip 29-dec-2010 till 22-Jan-2011: 24
Trip 31-dec-2009 till 5-feb-2010: 36

If I apply for ILR on 20-Sep-2013, does below calculation make sense?

Year 1 - 20 September 2013 to 19 September 2012: 0
Year 2 - 20 September 2012 to 19 September 2011: 14
Year 3 - 20 September 2011 to 19 September 2010: 40
Year 4 - 20 September 2010 to 19 September 2009: 36
Year 5 - 20 September 2009 to 19 September 2008: 0

In SET(O) do I have to mention only In and Out dates with reason? Or I have mentioned total number of days out as well?

--Continuous period looks fine make sure leave is counted properly.

Starts from 16-oct-2008. you can apply upto 28 days before your fifth anniversary from 16-oct-2008
Already confirmed twice.
