Hi, I am looking for some help re my partners immigration case
We have had a lot of trouble in the past trying to get a visa for my partner, he is currently signing onto immigration office every 5 weeks and we have submitted 2 cases (1 Appeal)
We have just received our second case back as being refused with no right to appeal
We have been together for two and a half years and just submitted an Article 8 Application. It has been refused on the grounds we do not have proof of living together for over 2 years as we were living with my parents at one point. First of all, will getting married solve this issue?
Also, it was refused on the grounds that there is no "insurmountable ostacles to family life with that partner continuing out of UK" and states "Whilst it is acknowledged your partner has lived in UK all her life and is in employment here, this does not mean you are unable to live together in India".
What would class as an insurmountable obstacle?
Granted, we could live in India if pushed to, however I do not want to leave myfamily, friends and job behind. My parents are very worried as they do not want me to go to India as they are aware of the troubles the country is facing at the moment and how dangerous it would be for me to relocate.
