ILR VISA and Dependents -Currently Tier 1 General

Post by stay786 » Tue Sep 17, 2013 4:57 pm

Hi There,

First of all thanks for your time.
My query is regarding ILR Application and my dependents

I am on Tier 1 General
My wife is on dependent Teir 1
My Elder boy born in UK and is on dependent Tier 1 (4 Years old)
My younger boy born in UK and have not applied for his visa as yet. (1 year old).

My question is do I need to apply for ILR for both my boys or I can apply for their British Registration directly after my ILR and don't apply ILR for them. I am getting different views so ended up in this forum.

Regards

Hope someone will be able to guide me here. I am going to apply for ILR in December and my current status is Tier 1 General.

Issue I am facing is that my wife suffers from severe anxiety and depression and that affecting her badly. She had already tried to sit for LIUK test couple of times and could not get through.

She is preparing again but I can't see her nowhere near to get through.
Now my questions are;
Can she apply for exemption from Koll as this issue is going on more or less 5 years; If not what are the options.

Would it be wise decision to include her in my application for ILR and do it through POE or I better get my ILR and apply for her separately by post.

Thanks much

following this disclaimer , look what i have found Smile

Page 64, Part 3 Section 3.1 (c) seem to exempt your wife from taking any tests.

so after 1st October 2013, this will become a law and you should benefit from this change in law ( i hope)

Indeed, so long as the medical practitioner write a supporting letter stating that due to mental health issues your spouse is unable to sit a test, that should suffice.

Thanks much guys for advice and sharing guidence docs.
Would a letter from her GP would be enough.I would appericiate if anyone have such letter template . Also should I include her in my application or wait for my application success and then apply for her saparately. Thinking to go for same day appoinment.
Last but not least; what are the chances that case worker refuse her application and don't accept GP letter.

Kind regards
