ILR as WP Dependent + PBS Dependent

Post by applefan123 » Tue Jan 07, 2014 11:33 am

I got my ILR recently via 5 year route (Work Permit + Extended as PBS Tier 2 ICT)

My Wife visa history:
Entered UK as Work Permit Dependent (JUN 2010).
Extended as PBS Dependent (on SEP 2012) valid until Sep 2015.

Now, she left to India in Jan 2013 for baby delivery and is currently in India (1 Year out of UK).

My wife stayed in UK from JUN 2010 to Jan 2013 with a break of 2 Months (out of UK) during this period.

Question1:
When my wife is back in UK next month as PBS Dependent, Can she apply for ILR directly without any wait (2 Year or 5 Year route)? Is her last one year stay out of UK any concern?

Question2:
My baby holds PBS Dependant visa. Do I need to apply for ILR or British Citizenship for Baby?

If Possible, Please send me UKBA reference links wherever applicable.

Kind Regards

Hi,

For Question 1 - Your wife may be eligible for ILR now if you can prove 2 years of cohabitation. Refer Q12 on this page http://www.immigrationboards.com/indefi ... 79378.html

For Question 2 - This might be helpful. See Q1 under Children section http://www.immigrationboards.com/britis ... 95747.html

Cheers
