First of all thanks for taking the time to read my post, my case is slightly complicated but hope its clear enough!
I arrived in the UK Sep 2006 and i was 12 years old at the time, i was a dependent of my father who was a phd student here. we stayed in the UK till 2012 (6 years) during that time i went to secondary school & high school for GCSEs then started A levels then dropped out to go to college for an IT course, we have visited home in 2 occasions for a period no longer than 2.5 months overall, i have built very strong ties and connections with the city i am living in considering i actually grew up here. in September 2012 we returned home as my father completed his studies and were unable to stay any longer as a family. i was planning to come back and start a foundation degree in January 2013 then start uni in September 2013. however, the very poor unstable situation back home did not allow that to happen (by unstable i mean war, militias, guns everywhere, kidnappings, assassinations, basically a post revolution apocalyptic state) so i had to stay put and start the process a little later on if things settle. later on 2013 i managed to get a very high IELTS mark even though the British council center was shut in several occasions due to bomb threats which also delayed my process, i then applied for a student visa in august 2013 for a year to complete my foundation year which i obtained. i came back to the UK in September 2013 after being home for a total of 1 year and completed my foundation degree then started uni with a Tier 4 visa valid for 4 years which i applied for within the UK. during my studies at uni i started working legally as a part time hotel receptionist and full time during holidays, i worked there for 2 years and left when i was able to get offered a job for a placement year in a different company as a marketer which is what i am currently doing as part of my degree. i worked for almost 3 years now and paid all my taxes and contributions, also i will be working during final year. by working here i have been able to develop my connections and strengthen my ties with the country even more.
i am starting my final year in September and by the time i graduate i would've spent half of my life in the UK, i am going to apply to settle in either; ilr 10 year route and asking Home Office to exercise discretion in my case and fight my way through it if i get rejected, or i will try the discretionary leave to remain the private life route as i am over 18 and under 25 and spent half of my life here, which will allows me to gain ilr after 6 years. what i want to know is what are the chances of me succeeding in either of them providing i supply sufficient evidence about my gap and also supplying my educational and employment history here.
Also a lawyer told me that if i apply for ilr and get rejected while my Tier 4 G visa is still running i will not have the right to appeal, i also read online that if i apply for a discretionary leave and it gets rejected while i have no running visa i will not have the right to appeal, are these correct? and when is the appropriate time to submit my application for either one?
p.s. all our visa extension applications while in the UK were made on time with 0 gaps and i have 0 criminal convictions
