solicitor negligence and next steps - URGENT

Post by hammad1224 » Tue Aug 01, 2017 3:26 am

Hi,

My wife FLR M application was refused somewhere in June 2016 with in country right of appeal. I instructed my solicitor for the appeal within 14 day period. I paid him the said fee. I also emailed him on 3 July 2016 for the confirmation whether he filed the appeal. He confirmed at that time that he filed

No after a year we didn't receive anything from court, i called the court to check when will be the hearing. I was surprised to hear that they didn't have anything in my wife's name.

I called solicitor and explained him the situation, he didn't come back to me almost a week. After a week a contact has been established. He said he wrote to court and he also has a copy of fax confirmation, he hasn't provided me that yet.
I now doubt if he is putting me in dark.

I already paid him £4000 for my appeal and my wife and I cant afford any more.

Please help me in this what should I do, gurus. Have you come across similar situations?

Regards

Are they a Solicitor registered with the Law Society, or an OISC Registered Immigration Advisor?

You first need to be sure that he is negligent.

do you have any child with your wife?

It takes couple of hours to file and appeal, and you paid him a not insignificant sums of money. I am puzzled why he did not file it. It seems so strange. He did not even make an out of time appeal. How did he think you were never going to find out. Quite strange.
