Help please - messed up expiry dates!

Post by dagsky08 » Fri Sep 01, 2017 10:55 pm

hi all, i hope i can get some quick advice on what to do as i have seriously messed up my visa expiry dates.

Background info:

- Granted refugee status in 2009 - 5yr visa given.
- Convicted to prison in 2010 - 14 months, review conducted by ukba whilst in prison and decided no further
action necessary.
- ILR application made (set protection route) 2014 - declined due to criminal record, however extended under paragraph 339Q for 3yrs

I mistakenly wrote down my visa expiry date as 15 sept but to my horror today whilst preparing my paperwork to meet with my solicitor on tuesday i have discovered that my visa actually expires on 5th Sept 2017! I have tried to contact my solicitor but i can't get hold of her, the firm only opens on Monday again and there is no emergency contact number. If i wait till Monday it will be the 4th Sept, even if she sees me on monday the mail will only get to Home Office on 5th September. I don't know if 5th September counts as getting it there on time or not or they will say that the application was late and then say i am an overstayer.

I have called over 20 firms to either no answer or they don't open on Saturday.

I am thinking of filling out form SET P and sending it off tomorrow so it arrives on Monday 4th Sept so it is still in time, and include a cover letter with the application stating further information to follow. The SET P form doesn't ask anything rocket science, its just basically personal info. Then when i get to see my solicitor on Monday/Tuesday she can then send in the additional information.

Any advice on how to handle this? And is SET P the correct form for my situation.

Thanks

Take a deep breath......the date of application is the date of posting, not the date the HO receive it. Send it by registered or recorded post and keep the receipt.

That's my understanding. You still have time to confirm with your legal advisor on Monday.

Thanks for your reply, I've just had a call back from my solicitor & she has made provision to see me tomorrow as she's in court on monday. Unbelievable that she's willing to give up her day off to help me & at no additional expense! Amazing is all i can say! She's NOT impressed at all at the situation but not many would be & i didn't dare start asking her a million questions over the phone. Happy days & fingers crossed all goes well :D
