ILR based on (Long Residence 10 years) and my wife's dependent Tier-2 visa

Post by Marzo » Thu Jan 11, 2018 1:12 am

Hi,
I have some questions regarding my family's Visas & Immigration situation:
A summary of our current case is as follows:

*** I have settlement visa ILR based on long residence (10 years) and I received it this week.
*** My wife has a dependent tier-2 visa at the moment and her visa will expired on 10/09/2018
*** My wife got her first visa to the U.K as a tier-4 student in Tunisia and her issued visa started from 29/09/2008, but her first entrance to the U.K was on 27/01/2009...So, she has a tier-4 student visa from 29/09/2008 until September 2014 as she finished all her studies and PhD in September 2014.
*** We married on 11/10/2010 and she was on Tier-4 student visa at that time, and from June 2015 she became a dependent Tier-2 visa on me until now and her current visa will expire on 10/09/2018.

So, my questions are:
1. Can my wife apply for settlement ILR in August 2018 based on her stay in the UK in the last 10 years? As she had a valid UK visa started from 29/09/2008 until 10/09/2018, but her first entrance to the U.K was on 27/01/2009 ????

2. After I received my settlement visa ILR now, so what is the case of my wife dependent Tier-2 visa now; is it will be cancelled now or still valid until 10/09/2018, as her current dependent-tier 2 visa will expired on 10/09/2018? so can she travel outside the U.K and enter again with her current dependent tier-2 visa or not?

3. If her tier-2 dependent visa will be cancelled now or invalid, what type of visa she needs to apply for? is it ILR? or Spouse visa? or family visa? or something else? when she needs to apply? is it within 28 days from getting my ILR

Thanks and I look forward to hearing from you. Your help and support are really appreciated :)

She should switch to FLR(M) as soon as possible, before traveling, and may apply for SET(LR) from Sunday, 30 December 2018.

ILR -based on 10 years- what will be the case for the dependent ?

Post by Marzo » Sun Jan 21, 2018 10:50 pm

Hi,
I have received my (ILR) as a long residence based on 10 years, and my wife is on dependent- tier2 visa now, As she will be eligible to apply for ILR as long residence based on 10 years in Feb 2019...
So, I have been told, that once I have received ILR settlement based on 10 years, her dependant visa will be cancelled and she needs to apply for another VISA ASAP...
So, my questions are:
1- Do you know which visa she should apply for?
2- Is it FLR (FP) or FLR (M)? what is the difference?

Thanks and I look fwd to hearing from you..

FLR(M) is for partner who satisfy all the normal requirements.
FLR(FP) is for partner who don't, perhaps subject to exceptions.
In the UK - apply by post or in person wrote:Fill in:

form FLR(M) if you can meet the requirements
form FLR(FP) if you can’t meet the requirements
