T2G to ILR: CCJ issues and later removed with certificate of removal do i have to declare?

Post by JP145 » Thu Aug 16, 2018 1:58 pm

Deal All, this forum is of great help in preparing for your visa application and lots of guidance. i have one more question before my ILR application.

I am on Tier 2 G and having company car and company arranges the insurance. I had minor accident and third party claimed repair. My Insurance company (arranged by my company) failed to settle claim in time and i received CCJ(22Dec14) for that debt. Insurance company paid the money and received CCJ removal certificate on 07Jan15. removal certificates states that record of this CCJ entry is removed from register.

can anyone please help whether i have to declare this CCJ which was issued to my name even it was due to insurance company fault of delayed payment? or i do not have to declare this as this entry is removed from register as per certificate?

Thank you all.

Yes declare, as it was issued. The question on the form is if one was ever 'issued' by the courts. Event if it has been satisfied or removed from the register just declare it (Same with any spent convictions) and explain on cover letter to avoid the 'deception trap'. CCJs will not normally affect your ILR success rates, least so if you have paid them off.
