Need some advice for Tier2 General dependent extension

Post by sreekanthreddyn » Tue Aug 06, 2019 4:19 pm

Could someone help me here please? currently I am on PR(granted in october 2018) and my family is still on tier2 general as they haven't met the 5 years criteria.
My wife and kids were in INDIA for 1 year in between hence there is a gap. They were granted tier2 general for 6 years which is the maximum duration for tier2 general; however, they need 1 more year to get PR and their tier2 visa ends in Nov 2019.

As i need to extend them for 1 more year, do i need to apply for tier2 general extenstion or PR dependent? If i apply for different visa(PR dependent) will the clock start again for 5 years from now?

VISA Stamping:
1st Tier2 (general) visa was granted on Nov 2013 to Nov 2016 - 3 years
2nd Tier2 (general) VIsa was granted on Nov 2016 to Nov 2019 - 3 years

Duration of their stay in UK:
march 26 2014 to may 8 2014 - 42 days
(1 year 3 months in INDIA)
august 2015 to till date - 4 years

Appreciate your valuable advice in this regards

I am sure you mean ILR and not PR, which is a status attained under the EEA/EU rules.
My wife and kids were in INDIA for 1 year in between hence there is a gap. They were granted tier2 general for 6 years which is the maximum duration for tier2 general; however, they need 1 more year to get PR and their tier2 visa ends in Nov 2019.

There is no '6 year cap' for PBS Dependents and not sure why you believe there is. It only applies to the main Tier 2 General visa holder. ILR not PR.
As i need to extend them for 1 more year, do i need to apply for tier2 general extenstion or PR dependent? If i apply for different visa(PR dependent) will the clock start again for 5 years from now?
There is no 'PR Dependent' visa category. Switching visa categories resets their clock to zero yes.
VISA Stamping:
1st Tier2 (general) visa was granted on Nov 2013 to Nov 2016 - 3 years
2nd Tier2 (general) VIsa was granted on Nov 2016 to Nov 2019 - 3 years

Duration of their stay in UK:
march 26 2014 to may 8 2014 - 42 days

august 2015 to till date - 4 years
There is NO absence limit for PBS Dependent visa holders whose visas were issued BEFORE 11th January 2018. Not sure why you believe they cannot apply for ILR (not PR) now. In fact, they could have applied last year in November already.
Char (CR001 not Casa)

Dear CR001, Appreciate the details. This is very helpful.

Yes, I was referring to ILR, sorry for the confusion created.

That's great news, so basically I can apply for ILR instead of applying for tier2 extension for my family.
I would be very grateful if you could help me with the list of documents required for PBS Dependent ILR application. As there is lot of confusion when I refer gov site.

I have seen your posts in the past as well, they are very much descriptive and helpful. Lot of people are getting benefited with your advices. Everyone should be very thankful for your kind support.

Regards
