ILR for Tier1 post April 2014

Post by Geminiuk01 » Tue Sep 03, 2019 2:17 pm

Hi all,

Just wanted some clarity on the rules on following:

1. Tier 1 entreprenuer granted in March 2014 BUT arrived in the UK on 14 April 2014.
2. Extension granted on 16 Jan 2018

Want to apply for ILR but confused on job creation requirements.

Reading the guidance at page 33 https://assets.publishing.service.gov.u ... -_0319.pdf

It states,

"3 You have:
(a) established a new business or businesses that has or have created the
equivalent of at least 2 new full time jobs for settled workers

The jobs must have existed for at least 12 months during your most recent
grant of leave or, where that leave was granted less than 12 months ago, for at
least the 12 months immediately before the date of your current application."

MY QUESTION is:
1. Do the two new jobs have to have been created on or after 16 Jan 2018? and last for any consecutive 12 month period from that date to now?

I ask because I wanted to use a job that was created in September 2017 and is still existing now?

Many thanks in advance

Gem

The existing job is fine as long as it existed 12 months AFTER your extension was granted
